The following terms and conditions are upon which Service My Gas Heater (ABN: 87 346 805 938) and any person acting on its behalf and with its authority will provide gas fitting services to any person, business or corporation that engages Service My Gas Heater to provide gas fitting services (“client” or "purchaser").

Website

The Brand names, logos, written contents and images used in this website are for educational and contextual use only. Service My Gas Heater is not affiliated or a representative of any business or manufacturer of products we service or repair. The design and contents of the Service My Gas Heater website are subject to copyright, not including logos or lifestyle stock images used from product brochures of appliances we support via service and repair.

Service Technicians

NO FIX, NO CHARGE - In the event our Service Technicians cannot fix the problem due to lack of technical skill, there is no charge for the call out. However IF we're unable to service or repair the appliance due to obsolete parts or non-compliant installations, we reserve the right to charge a call out fee ($165)

Our Service Technicians are fully qualified Gas Fitters with a Restricted Electrical Licence and covered by our $10m PL insurance policy.

Service My Gas Heater Fees

Once the appliance fault is discussed and our Technician arrives on-site, the diagnosis is confirmed and our Technician proceeds with the Service or Repair, our total fee is $330 inc. GST, plus parts

Service My Gas Heater reserves the right to charge a minimum fee for any (but not limited to) inspection service, advice or proprietary knowledge that assists the ‘client’ in alleviating a problem.

IF our service Technician is unable to discuss or diagnose a fault from our initial telephone conversation and the client wishes to proceed with our attendance, we charge an initial $165 call out fee within business hours (8am to 5pm, Monday to Friday) irrespective of the outcome. Our call out fee is based on a minimum labour charge time per job (45min). Our rates beyond the initial call out are charged in 15 minute increments.

Quoted or estimated priced works are accepted by Service My Gas Heater (but not limited to) verbally, in writing (of any form) or via Service My Gas Heaters’ quote acceptance email links. Accepted quotes become a legally binding contract between Service My Gas Heater and the 'purchaser', as per Victorian Government guidelines relating to consumers around quotes, estimates and contracts.

New parts remain the property of Service My Gas Heater until the account is settled in full and the appliance is deemed functional.

In the instance that works are diagnosed by others, Service My Gas Heater take no responsibility for incorrect diagnosis or damages caused.

In the event that Service My Gas Heater are ‘called back’ to a previously attended job due to repairs undertaken still contributing to a fault, fees will not apply for re-attendance (only if in line with ‘Limited 12 month part warranty & 6 month labour guarantee’ on primary fault issue - definition below). In the event that we attend and work undertaken by us is not at fault and a new issue is present, Service My Gas Heater reserve the right to charge additional fees.

After hours charges apply if working outside of normal hours. Normal hours are between 8am and 5pm, Monday to Friday.

Definitions

‘Call out Fee' means when a service technician is called to service or repair your appliance and arrives at your premises, between business hours (8am to 5pm, Monday to Friday). A minimum time on site is charged per job attended to.

‘Free quotes’ include broad estimates only. Detailed plumbing consultancy services are available at an additional cost. This includes (but isn't limited to) advice or proprietary knowledge that offers further assistance in alleviating problems.

A quote may be given and accepted by the 'client' verbally. All accepted quotes will be invoiced at the agreed rate, unless new rates are applied due to exclusions applicable.

Quoted prices are only relevant if Service My Gas Heater technicians have uninterrupted and free access to site. If Service My Gas Heater are forced to leave / return due to access issues, parts or services supplied by other parties not being to standard (but not limited to), additional costs may apply.

'Limited 12 month warranty on Parts' applies to new parts installed by our qualified technicians.

‘6 month labour guarantee’ applies to only workmanship undertaken by Service My Gas Heater and not applicable on parts or materials. This is due to (but not limited to) the general ware and tare of materials being outside of Service My Gas Heaters’ control once installed.

Missed Appointment Cancellation & Time Policy

Service My Gas Heater have a 24 hour missed appointment / cancellation policy to ensure each gas technician is scheduled the correct amount of time, to arrive promptly to each scheduled job.
If an appointment is made with less than 24 hours notice, then it immediately falls within this policy.
A minimum of 24 hours notice is required to cancel or change confirmed appointments or on-site quotations.
Standard hours missed appointment / cancellations incur a $90 inc GST fee.
We do understand that things happen unexpectedly and we will do our best to accommodate changes to appointments, where we can, at no extra cost.

Photographs

Service My Gas Heater may take photos of the site and/or works for proof of workmanship or liability purposes. These photographs may be used by Service My Gas Heater for promotional purposes.

 

Payment of Invoices

Clients must pay full invoices within 48 hours of the completed service or repair. If not paid in full within 48 hours Service My Gas Heater reserves the right to charge late payment fees.

All materials remain the property of Service My Gas Heater until all outstanding balances are paid in full by client.

Service My Gas Heater reserves the following rights in relation to the goods until all accounts owed by purchaser to Service My Gas Heater are paid in full:

a) Legal ownership of the goods and services provided

b) To enter the purchaser's premises (or the premise of an associated company or agent where the goods are located) without liability or trespass to retake possession of goods).

c) Service My Gas Heater will not be liable for any resulting damage associated with retaining possession of goods and services.

d) Costs to remove materials in ownership of Service My Gas Heater will be charged to the customer.

e) Any associated debt collection costs incurred to recover debt and repossess goods or services, will be charges to the client.

Access

It is the client’s responsibility to provide appropriate and safe access to the area of works.

Service My Gas Heater takes as much care as possible, however, will not be held responsible for (but not limited to) cracking foundations, correcting unforeseen problems of any structure, service or earth including existing plumbing and gas services. For example: where no detailed construction drawings are provided and/or where cutting, drilling or demolition works have been approved by client without adequate investigation or preparation by the client.

Service My Gas Heater will provide a variation to price to make safe or correct any unforeseen circumstances at the client’s request.

Unforeseen Circumstances

If condition and/or circumstances are encountered at this job site which are (1) concerned physical conditions, or (2) unknown physical condition of an unusual nature, which differ materially from that which is visually ascertained, client agrees to accept responsibility for such conditions and those circumstances outside the control of Service My Gas Heater and further agrees to pay for any labour or materials, including repair to damaged equipment of Service My Gas Heater and other plumbing caused by such conditions and/or circumstances.

It is in the intent of this provision to make client responsible for all (1) unforeseen and concealed conditions (2) for that which Service My Gas Heater cannot control. Accordingly; the client further agrees to hold Service My Gas Heater harmless and shall indemnify and defend Service My Gas Heater and all its agents and employees from and against all claims, damages, losses and expenses including but not limited to solicitor fees, consequential damages, arising out of as a result from the performance of Service My Gas Heater's work involving, affecting, or relating to such unforeseen or concealed conditions regardless of whether such damages are caused in part by Service My Gas Heater, except for Service My Gas Heater sole negligence.

Service My Gas Heater will not be held responsible for any resulting damages as a result of fulfilling their duties in their entirety, including but not limited to, removal of structures, gyprock, walls for access, removal of garden beds, paving and concrete for access, cracking of ceiling / roof spaces as a result of not being secure, bench, countertop and working area damages as a result of required chemicals (blocked drains).

Asbestos or other Hazardous Materials Remediation Work – Service My Gas Heater has no information whatsoever with respect to asbestos or other hazardous materials or substances in any portion of the customer’s property and has not conducted any investigation in connection herewith. Service My Gas Heater does not perform asbestos or other hazardous material or substance removal and shall have no responsibility whatsoever for any such removal. The client expressly releases and shall hold Service My Gas Heater harmless from any liability whatsoever and for all claims arising out if its presence, release, remediation or removal and for any costs, losses or damages the client may suffer or sustain if it is found to exist on the customer's property.

Call Back To Site

Service My Gas Heater may charge another standard fee for attending site if the reason for re-attendance was not in the scope of Service My Gas Heaters’ works. This may relate (but is not limited) to circumstances in which the client has advised they will provide materials or coordinate a dependent service, and materials or the site isn’t up to standard for the plumber to start works.

Public Liability and Licensing

Service My Gas Heater agree to keep all insurances including public liability up to date and valid, along with all contractor’s licenses

The client indemnifies and holds harmless the contractor and Service My Gas Heater against any loss, threatened or otherwise, or expense by reason of the liability of the contractor arising out of any claim for damaged for personal injury, or property damage to either the site or to the moveable property on the site
